TREASON IN CONGRESS? UNLAWFUL ORDERS?

There is much talk today about the video made by six Democratic Members of Congress, implying that the President is issuing illegal orders to the military, navy, and intelligence community, and that they should refuse to obey unlawful orders. Did they do anything wrong? Let’s look at it together.

So, on the surface, they just told service members to refuse to obey unlawful or unconstitutional orders. What could be wrong with that?

Let me tell you.

Welcome to the SabersEdge Article for November 22, 2025 – Cutting Through the Lies to Get to the Truth and Reforging the Foundations of the West.

The law in question is 18 U.S.C. § 2387, and it is part of Chapter 115 of Title 18 (“Treason, Sedition, and Subversive Activities”). It was initially enacted during World War I and expanded during World War II and the Cold War to prevent interference with military recruitment, operations, and morale, especially in wartime or during periods of national emergency.

As a Counterintelligence Special Agent, it was my annual duty to provide the annual SAEDA briefings to any unit, government defense contractor, or body of officers that requested it within my jurisdiction, and I personally gave many of them as both an agent and the Acting Special Agent in Charge of the Resident Office that I was assigned to. This was during the height of the Cold war (in the 1980s when President Reagan and later President George Bush, Sr. were Commanders in Chief of the US Military, and the Soviet Union was still a very active threat to our security.) As an agent, I accompanied our SAIC during the briefings and assisted him. Later, as the Acting Special Agent in Charge, I conducted all the briefings in our area myself because I liked to get out and interact with people in the field.

SAEDA stands for Subversion And Espionage Directed Against the Army. One of our more pleasant duties as a Counterintelligence Special Agent and as the Acting Special Agent in Charge was to conduct these briefings to the soldiers, civilian contractors, researchers, or technical facility personnel that maintained government contracts, research or operations with contracts that affected the military combat, air, ground, and missile forces of the United States Army. This included everything from ground combat forces and training units to TOP SECRET research facilities with projects classified up to and including as Sensitive Compartmented Information [SCI] that requested such support in southern New Jersey from Trenton and Jersey City south, eastern Pennsylvania including the City of Philadelphia and the military contractors and classified research facilities in the area around Philadelphia, King of Prussia, and across the river near and around Camden. As you can see, I have direct professional knowledge, training, and experience on this exact question; more than your regular service member or officer would have.

So first, we are talking about some big words here. What is subversion? What is sedition?

According to Webster Subversion is “a systematic attempt to overthrow or undermine a government or political system by persons working from within.”

Sedition is “incitement of resistance to or insurrection against lawful authority.”

I am not a lawyer. I am too honest for that. But by any honest standard, the video below is just such an attempt. Why? Let me tell you.

There is technically nothing wrong with the exact words they used about not obeying illegal orders. It is the duty of every soldier to disobey unconstitutional or unlawful orders. When I was in the military, both as an enlisted man and during officer training, we had classes on our duty to refuse illegal and unconstitutional orders.

Every soldier is sworn, unlike the armies of the Roman Empire or Nazi Germany, which swore loyalty directly to the Emperor or Führer. Still, the American Soldier, Airman, Seaman, and Guardian, all swear their loyalty directly to the Constitution of the United States and to defend the Constitution against “all enemies foreign and domestic.” [for an explanation on the sophistry of modern media see: How Are you Being Lied To? So, their defense is that they were simply telling our defenders of freedom to keep up their duties and refuse to disobey unlawful and unconstitutional orders. Or so they are claiming.

However, the reality of how the message is perceived is very different from what they claim, at least in this patriot’s professional opinion.

Here is the exact current text of 18 U.S.C. § 2387 (as it appears in the United States Code today, unchanged since 1994):

§ 2387. Activities affecting armed forces generally

(a) Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:

(1) advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States; or

(2) distributes or attempts to distribute any written or printed matter which advises, counsels, or urges insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States— Shall be fined under this title or imprisoned not more than ten years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.

(b) For the purposes of this section, the term “military or naval forces of the United States” includes the Army of the United States, the Navy, Air Force, Marine Corps, Coast Guard, and the Space Force, as well as the reserve components thereof while they are on active duty or performing inactive-duty training.

That is the complete and verbatim text of the statute as of November 2025 when I write this article for SabersEdge.Online.

The six members of congress who made the video themselves claim to have had the intent to “raise awareness” or by other use of sophistry that tries to excuse their actions. They seem to have had the plan to hide behind their exact words which are technically calling members of our naval, military, air force, and intelligence organizations, to do their duty. However, this is not a valid defense! Stay with me and I will tell you why.

So, what does all this legal stuff mean in plain English?

This law makes it a serious federal felony (with penalties of up to 10 years in prison + fines + 5-year ban on federal employment) to intentionally try to undermine the U.S. military by producing any advice or material with the intent –

“to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:”

or that:

“advises, counsels, urges, or IN ANY MANNER causes OR ATTEMPTS TO CAUSE insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States; “

While the “Seditious Six” are trying to hide behind the idea that they are simply stating the law they made an error that signifies their intent was to disrupt the chain of command and cast doubt on the military’s actions under this administration. They began with a statement that ‘Trump is pitting the military and intelligence community against the American people.’ This statement reveals that they are not “just quoting military law” but are actually directing their comments to undermine this administration. The message is crafted with the precision of an intelligence disinformation program that our CIA has used ad nauseum to undermine the governments of foreign countries – (just as they did in the Ukraine before toppling its government and replacing it with one that Obama and Biden could control to provoke war with Russia). It is pretty clear to me that their intent was to do EXACTLY this and sow disunity in the ranks of our military and defense intelligence forces hopefully strong action will be taken and the congress will act to make it easier to remove elected officials and government personnel who violate their oaths to support and defend our constitution. I believe that these members of congress are going to attempt to hide behind the defense that they were only urging service members to obey the law. However, it appears to me that their intent was to sow distrust in the Commander in chief and his orders and decisions.

Let me be clear. ANY SERVICEMEMBER who refuses a direct order of their commander and chief or their duly appointed representative better be 100% certain that the law and the constitution is backing them 100% percent because they are risking losing all pay and benefits, they have accrued in their years of military service by taking that step. NO MEMBER of the military has the knowledge to make that decision without consultation with a JAG officer (Judge Advocate Generals Office lawyer) about the legality. However, almost no one is going to have the benefit of that advice at the moment they make that decision. They are taking their entire lives in their hands, and they better not be making that decision based on the TDS [Trump Derangement Syndrome], sedition, or subversion of six members of congress or the media. Or they will be coming to visit my community and the military confinement facility at Fort Leavenworth for up to ten years in prison.

In my opinion any member of congress that would issue such advice knowing that the service members don’t have the legal understanding to make these decisions and that by sowing such seeds of “insubordination, disloyalty, mutiny,” and “refusal of duty” among service men and women shows a callous disregard for others and their welfare and livelihood.

LET ME BE CLEAR. VIRTUALLY EVERY ORDER THAT TRUMP HAS GIVEN THAT HAS BEEN CHALLENGED AT THE TIME OF THIS WRITING HAS SUPPORTED THE LEGAL AUTHORITY OF THE PRESIDENT TO GIVE THE ORDERS AND MAKE THE DECISIONS THAT HE HAS.

This has been verified by the United States Supreme Court. Which means that disobeying any order given to date, that has been reviewed by the supreme judicial authority in the United States – the only one that matters legally – has supported the President.

That means anyone who has refused one of these orders so far they may wel be in big trouble and it therefore does not look good for anyone who chooses to refuse any order which the President seems poised to make in the foreseeable future. SO BEWARE!

I for one have sometimes been disappointed that Trump hasn’t acted more decisively. For six members of congress to make these statements STRONGLY IMPLYING that the President has already issued illegal and unconstitutional orders or is about to do so seems to me to have met the INTENT clause of the law. However, intent is hard to prove in court. I believe the Democratic lawmakers who are risking the careers of good men and women are hoping to hide behind these technicalities and the history that this law hasn’t been used to prosecute anyone since the Cold War. But it is still the law and the DOJ can prosecute if it so desires. And I believe that it absolutely should begin building its case and prosecute to the full extent of the law!

Again, I believe the Democratic Lawmakers are taking this step and counting on the fact that this law, established during World War II in 1940 (before the United States entered the war,) has been rarely prosecuted. In part because it must be directed toward the members of the military or naval forces and general speech and criticism is not sufficient.

Pure political criticism of the military, wars, or government policy is protected by the First Amendment. But that is not what this was. It was a message directly to the military to sow distrust in their Commander in Chief and that is shown by their clear statement at the beginning where they claim that Trump is using the military and the intelligence community against Americans. Within that light, it is clear their following statements are there “to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:” or “IN ANY MANNER causes OR ATTEMPTS TO CAUSE insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States; “

This message was directed at serving troops strongly implying they should disobey and/or mutiny against the President or War Department’s orders. The urge to fulfill their obligation to disobey unlawful orders cannot be separated from their initial accusation that Trump is trying to set the military and intelligence communities against the American People. It is, I believe, and out and out lie, but their assertion exists none-the-less. The fact that they did not actually give any example of an illegal order (such as the Mai Lai Massacre in the Viet Nam War) actually strengthens the argument that their intent was to sow dissent and disorder in the military. If so this is not protected speech but a violation of US Law!

For those who believe they have been given an unlawful or unconstitutional order the training that I remember encourages service members to

1. Request a clarification to ensure they understand the order. It could be that they misheard or misunderstood the order they have been given. However, if their commander has given them an illegal order he or she probably knows or suspects it is illegal and asking for a clarification is sometimes enough to get them to withdraw that order.
2. If the order is repeated and they strongly feel that it is an illegal order then they have a decision to make. Are they sure enough of their own understanding of Constitutional Law and authority to stake their career and freedom on it? I would advise caution. In my experience the last couple generations have a horrendously warped understanding of what the Constitution and their rights are. We have been subjected to intense Communist subversion for over 60 years specifically intending to undermine our institutions and understanding of our own laws and rights. I would not base my life on the constitutional undestanding of most Americans – although many of them – such as you Freedom Troopers and readers of SabersEdge.Online and other sites are rapidly educating themselves on these issues.

This is a serious issue and no service member should risk their career based upon the base propaganda that passes for news on most mainstream media sources.

Personally, I hope that the political careers of these Democratic Lawmakers are forever ended and that they are removed from office because I do believe that they have intentionally violated this law. But that is a matter for the Department of Justice, and the Courts to decide and I want to see this matter taken to court and clarified clearly for all Americans today and for tomorrow.

I encourage you to write your own congressmen and make your own opinions felt on this issue. For too long subversion and sedition has been tolerated in this country and it has reached the point of open insurrection. If this is not resolved we are on the road to open insurrection, further erosion and collapse of government confidence, and possibly even Civil War and those are all outcomes that our children and our children’s children will be paying for over a very long period of time.

The Seditious Six are trying to hide behind the same technicality as the meme I made below to illustrate my point. In this people read the headline, see the pictures, and even if the read the disclaimer below the damage and seeds of distrust have already been sown in their minds.

This is exactly what the Seditious Six did to undermine the military. It doesn’t matter that it IS a soldier’s duty to refuse unlawful orders, they are sowing seeds of distrust and causing uncertainty in the minds of our military to disrupt the chain of command and to “interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States” and to advises, counsels, urges, or IN ANY MANNER causes OR ATTEMPTS TO CAUSE insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States;” This is exactly what these snakes did and they did it hiding behind the facade of patriotism in the best tradition of Benedict Arnold – America’s first traitor.

Again, let me point out the assassination of Caesar and Plutarch’s words. It doesn’t matter how many enemies there are. It matters where they are. And the enemies of the United States have slithered their way into congress and our government and intelligence agencies from where they are trying to bring down a duly elected government of the American people in direct defiance of the intent of the Constitution of the United States. We have seen this before with the lies and disinformation campaigns of the Democrats and media in Trump’s first administration. But we are wiser to their seditious ways now.
